You have some flexibility with regard to the format of the case comment. Case comments are often written in the format of legal memoranda. In other words, an introduction section, followed by the facts, issues, law, discussion, legal analysis and conclusion in short paragraphs and use headings. Make sure the assignment is clear, logical and easy to follow.
Key aspects are a proper understanding of the reasoning of the Supreme Court of Canada as well as your own analysis which should follow. was the case correctly decided? Was the court’s disposition correct but the reasoning of the court was incorrect? Is the whole area of the law confusing and problematic and you believe there is a better approach? are the wider societal implications of the decision?
